The Service Provider reserves the right to amend these Terms at any time. The current version of these Terms is always available on the Website. Any amendments shall take effect upon publication on the Website. Orders already placed shall be governed by the Terms in effect at the time the order was placed.

3. Scope of the Terms

These Terms apply to all purchases made through the Webshop at https://sundeer.hu and to all on-site ticket purchases at the Festival venue. The Terms apply equally to Consumers and non-consumer Buyers, except where specific provisions expressly apply only to Consumers.

The legal relationship between the Service Provider and the Buyer is governed by these Terms, the applicable provisions of Hungarian law — in particular Act V of 2013 (Hungarian Civil Code), Act CVIII of 2001 (on certain aspects of electronic commerce services and information society services), Government Decree 45/2014 (II.26.) (on the detailed rules of contracts between consumers and businesses), Act CLV of 1997 (on consumer protection), and Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR).

4. Products

The Webshop offers the following products for sale:

  • Day Tickets — granting entry to the Festival for one specified day.
  • Passes — granting entry to the Festival for its entire duration (all days).

Detailed descriptions, pricing, and availability of each Ticket type are displayed on the relevant product pages in the Webshop. The Service Provider makes every reasonable effort to ensure that product descriptions, photographs, and other information displayed in the Webshop are accurate and up to date.

Tickets purchased through the Webshop are electronic tickets delivered via email. Tickets purchased on site at the Festival venue are evidenced by a receipt issued at the point of sale.

5. Ordering Process

Orders through the Webshop are placed as follows:

  1. Ticket selection: The Buyer selects the desired Ticket type(s) and quantity on the Website and adds them to the shopping cart.
  2. Cart review: The Buyer reviews the contents of the shopping cart, including the selected Tickets, quantities, and total price.
  3. Checkout: The Buyer proceeds to the checkout page and fills in the required billing information (name, email address, billing address, and any other mandatory fields).
  4. Payment method selection: The Buyer selects the preferred payment method (credit/debit card payment via Stripe, or direct bank transfer).
  5. Order placement: The Buyer reviews the order summary, accepts these Terms and Conditions, and submits the order by clicking the order confirmation button. By placing the order, the Buyer makes a binding offer to purchase the selected Tickets.
  6. Order confirmation: Upon successful payment (or, in the case of bank transfer, upon receipt of payment), the Service Provider sends the Buyer a confirmation email containing the order details, the electronic Ticket(s), and the invoice.

The contract between the Service Provider and the Buyer is concluded when the Buyer receives the order confirmation email from the Service Provider. In the case of bank transfer, the contract is concluded upon receipt of the full payment by the Service Provider and the subsequent sending of the confirmation email.

The Service Provider is not responsible for errors arising from incorrect or incomplete data provided by the Buyer during the ordering process. If the Buyer discovers an error in their order before payment is completed, they may correct it by modifying the contents of their cart or by contacting the Service Provider.

6. Payment Terms

The Buyer may choose from the following payment methods:

  1. Credit/debit card payment via Stripe: Online card payments are processed by Stripe Payments Europe, Ltd. (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland). The payment is processed in real time. The Buyer’s card details are handled exclusively by Stripe in accordance with PCI DSS standards; the Service Provider does not store or have access to the Buyer’s card data.
  2. Direct bank transfer: The Buyer transfers the total order amount to the Service Provider’s bank account indicated on the order confirmation page and in the confirmation email. Payment must be received within 5 (five) business days of placing the order. If payment is not received within this period, the Service Provider reserves the right to cancel the order without further notice.

The Buyer may choose to pay in Hungarian Forint (HUF) or Euro (EUR), at their discretion. The selected currency applies to the entire order.

Payment is considered complete:

  • For card payments: when the transaction is successfully authorised and confirmed by Stripe.
  • For bank transfers: when the full amount is credited to the Service Provider’s bank account.

Tickets are issued and delivered to the Buyer only after payment is complete.

7. Prices

All prices displayed in the Webshop include Value Added Tax (VAT) where applicable. Prices are displayed in both Hungarian Forint (HUF) and Euro (EUR).

The Service Provider reserves the right to change prices at any time. Price changes do not affect orders that have already been placed and confirmed. The price applicable to an order is the price displayed in the Webshop at the time the order is placed.

In the event of a manifestly erroneous price (e.g., a price that is obviously incorrect due to a technical error, such as a price of HUF 0 or a price significantly deviating from the known market value of the product), the Service Provider is not obligated to deliver the product at the erroneous price. In such cases, the Service Provider shall promptly inform the Buyer and offer the product at the correct price, or the Buyer may cancel the order. If payment has already been made, the Service Provider shall refund the full amount without undue delay.

8. Invoicing

The Service Provider issues electronic invoices for all purchases in compliance with Hungarian tax regulations. Invoices are generated automatically by the szamlazz.hu invoicing system, operated by KBOSS.hu Kft.

Upon successful payment, the invoice is generated automatically and sent to the Buyer’s email address together with the order confirmation and electronic Ticket(s).

For on-site purchases at the Festival venue, the Buyer receives a receipt at the point of sale.

It is the Buyer’s responsibility to provide accurate billing information during the ordering process. The Service Provider cannot be held liable for invoicing errors caused by incorrect data provided by the Buyer.

9. Right of Withdrawal

IMPORTANT NOTICE: Festival Tickets are exempt from the 14-day right of withdrawal.

Pursuant to Section 29(1)(l) of Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, the Consumer does NOT have the right to withdraw from the contract in the case of services related to leisure activities (including festivals and cultural events) where the contract specifies a specific date or period of performance.

Since all Tickets sold through the Webshop relate to the Festival — a leisure event with a specific date of performance — the 14-day right of withdrawal provided for in Section 20 of Government Decree 45/2014 (II.26.) does not apply to any Ticket purchases.

By placing an order, the Buyer expressly acknowledges and accepts that they cannot exercise the right of withdrawal with respect to the purchased Tickets.

This exemption is in accordance with Article 16(l) of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.

10. Refund Policy

All Ticket sales are final. No refunds will be issued under any circumstances, including but not limited to:

  • The Buyer’s inability to attend the Festival;
  • Personal scheduling conflicts;
  • Travel disruptions or visa issues;
  • Health-related reasons;
  • Dissatisfaction with the Festival programme or experience.

By completing a purchase, the Buyer acknowledges and accepts this no-refund policy.

In the event that the Service Provider cancels the Festival entirely and does not reschedule it, the Service Provider shall refund the Ticket price to the Buyer. This is the sole exception to the no-refund policy.

11. Ticket Validity and Usage

11.1. Personal Nature of Tickets

Each Ticket is personal and is issued in the name of the person specified during the ordering process. The Ticket bears the Buyer’s name and email address. Upon entry to the Festival, the Ticket holder may be required to present valid identification matching the name on the Ticket.

11.2. Ticket Transfer

Tickets may be transferred to another person upon prior request to the Service Provider. To request a transfer, the Buyer must contact the Service Provider at sundeerinfo@gmail.com or (+36) 20 363 4076, providing the original Ticket holder’s details and the new attendee’s full name and email address. The Service Provider reserves the right to approve or deny transfer requests at its sole discretion.

11.3. Ticket Validity

A Day Ticket is valid for entry on the specific day indicated on the Ticket. A Pass is valid for entry on all days of the Festival. Tickets are valid only for the Festival edition (year) for which they were purchased.

11.4. Entry Conditions

The Ticket holder must present a valid Ticket (electronic or printed) at the Festival entrance. The Service Provider reserves the right to verify the identity of the Ticket holder. Entry may be denied if the Ticket is invalid, duplicated, or if the holder cannot provide satisfactory identification.

12. Festival Rules

All Festival attendees are required to comply with the following rules and any additional house rules communicated by the Service Provider at the Festival venue:

  • Attendees must follow the instructions of the Festival organisers and staff at all times.
  • Attendees must behave in a respectful and considerate manner towards other attendees, performers, staff, and the natural environment of the venue.
  • Pets are not allowed at the Festival venue. This rule applies without exception.
  • Attendees must not engage in any illegal activity on the Festival premises.
  • Attendees must not bring prohibited items to the Festival venue. The list of prohibited items, if applicable, will be communicated by the Service Provider prior to the Festival.
  • The Service Provider may establish and communicate additional rules or guidelines prior to or during the Festival. Such rules form an integral part of these Terms.

The Service Provider reserves the right to deny entry to or remove from the Festival venue any person who violates these rules, the house rules, or whose behaviour endangers the safety, well-being, or enjoyment of other attendees. In such cases, no refund shall be issued.

13. Liability

13.1. Limitation of Liability

The Service Provider shall not be liable for:

  • Errors, losses, or damages arising from incorrect, incomplete, or inaccurate data provided by the Buyer during the ordering process.
  • Technical malfunctions, interruptions, or errors of the Website, the Webshop, the payment processing system, or any third-party service, except where such issues are directly and exclusively caused by the Service Provider’s wilful misconduct or gross negligence.
  • Delays or failures in email delivery, including but not limited to order confirmations, invoices, and electronic Tickets, caused by the Buyer’s email service provider, spam filters, or incorrect email addresses.
  • Any personal injury, property damage, or loss incurred by the Buyer or any Festival attendee during or in connection with the Festival, except where caused by the Service Provider’s wilful misconduct or gross negligence.

13.2. Force Majeure

The Service Provider shall not be liable for any failure to perform or delay in performing any obligation under these Terms if such failure or delay results from circumstances beyond the Service Provider’s reasonable control, including but not limited to: natural disasters, extreme weather conditions, epidemics or pandemics, war, terrorism, civil unrest, strikes, government orders or restrictions, power outages, or failures of telecommunications or internet infrastructure (hereinafter: “Force Majeure”).

13.3. Event Modification and Cancellation

The Service Provider reserves the right to:

  • Modify the Festival programme, schedule, lineup, venue layout, or other aspects of the Festival at any time, without prior notice and without liability.
  • Cancel or reschedule the Festival in whole or in part due to Force Majeure or other circumstances beyond the Service Provider’s reasonable control.

In the event of a complete cancellation of the Festival without rescheduling, the provisions of Section 10 regarding refunds shall apply. In the event of partial cancellation, rescheduling, or programme modification, no refund shall be issued, as such changes do not affect the fundamental nature of the Festival as a leisure event.

14. Data Protection

The Service Provider processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and applicable Hungarian data protection legislation. Details regarding the collection, processing, and storage of personal data are set out in the Service Provider’s Privacy Policy, which is available on the Website.

By placing an order, the Buyer acknowledges that the Service Provider will process the personal data provided during the ordering process (including name, email address, billing address, and phone number) for the purposes of order fulfilment, invoicing, Ticket delivery, and communication regarding the Festival. The legal basis for this processing is the performance of the contract between the Service Provider and the Buyer (Article 6(1)(b) GDPR).

15. Complaints and Dispute Resolution

15.1. Direct Complaint to the Service Provider

The Buyer may submit complaints or inquiries directly to the Service Provider using the following contact details:

  • Email: sundeerinfo@gmail.com
  • Phone: (+36) 20 363 4076

The Service Provider shall investigate and respond to complaints within 30 (thirty) days of receipt.

15.2. Consumer Protection Authorities

The consumer arbitration boards operate under the auspices of the county (Budapest) chambers of commerce and industry. The Consumer may contact the arbitration board competent for their place of residence or domicile, or the arbitration board competent for the Service Provider’s registered address.

Information on the contact details of the competent consumer arbitration boards is available at: www.bekeltetes.hu

15.4. Online Dispute Resolution (ODR) Platform

For Consumers residing in the European Union, the European Commission provides an Online Dispute Resolution (ODR) platform for the resolution of disputes arising from online purchases. The ODR platform is accessible at:

https://ec.europa.eu/consumers/odr

15.5. Court Proceedings

If the dispute cannot be resolved through the above methods, either party may initiate court proceedings before the competent Hungarian court in accordance with the applicable rules of civil procedure.

16. Governing Law and Jurisdiction

These Terms and any disputes arising out of or in connection with these Terms, including disputes relating to the existence, validity, or termination of these Terms, shall be governed by and construed in accordance with the laws of Hungary.

Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent Hungarian courts.

17. Final Provisions

  • These Terms are effective as of 11th of March 2026.
  • The Service Provider reserves the right to amend these Terms at any time. The amended Terms shall take effect upon publication on the Website. The current version of these Terms is always available on the Website.
  • If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.
  • The Buyer acknowledges that these Terms, together with the Privacy Policy and any specific terms displayed on the product pages of the Webshop, constitute the entire agreement between the Service Provider and the Buyer with respect to the purchase of Tickets.
  • Failure by the Service Provider to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • These Terms are published in Hungarian and English. In the event of any discrepancy between the Hungarian and English versions, the Hungarian version shall prevail.
